MBR addresses 'free rider' surcharge

The following statement is found on the latest version (January 2007) of the Medical Benefits Request Form (MBR):

    "I understand that my employer may be notified and billed for services if I or any of my dependents get services from hospitals or community health centers paid for by the Uncompensated Care Pool in accordance with regulations found at 114.6 CMR 12.00."

Because the statement is located on the MBR's signature page, some clients worry that they are giving the state permission to bill their employers. By signing, the applicant is only declaring that s/he is aware that this could happen.

The health care reform law gives the state the authority to charge a "free rider surcharge:" that is, to recover medical expenses from employers with more than 10 employees who do not offer a Section 125 plan to employees.
